Acceptable Use Policy
Last updated October 23, 2026 · ElevateAI
This policy is the single rulebook for how the ElevateAI Services may and may not be used. It defines prohibited conduct, the business categories we do not serve, the rules for messaging and email, the restrictions on our AI features, the standards for content you post, and your responsibility for complying with the laws that apply to your business. It applies to everyone who uses the Services, including your authorized users, and it is part of your agreement with us under the Terms and Conditions.
1. About This Policy
1.1 This Acceptable Use Policy (the "Policy") is issued by ElevateAI ("ElevateAI") and applies to all use of the Services, all Content and all Contributions, as defined in the Terms and Conditions, Section 2.
1.2 By using the Services you agree to this Policy. You are responsible for making sure your authorized users, employees, agents and clients who use the Services through your account also comply; their violations are treated as yours.
2. Relationship to the Terms and Conditions
2.1 This Policy is part of your agreement with us and should be read with the Terms and Conditions. Under the order of precedence in the Terms and Conditions, Section 5.2, this Policy is the sole source of truth for prohibited conduct, prohibited business categories and AI-use restrictions.
2.2 A violation of this Policy is a breach of the Terms and Conditions.
3. Prohibited Conduct
3.1 You may not use the Services for any purpose other than those we make them available for. In particular, you may not:
- (a) systematically retrieve data or content from the Services to build a collection, database or directory without our written permission, or use any robot, scraper, spider or other automated tool to access the Services except through interfaces we provide;
- (b) collect usernames or email addresses of users to send unsolicited messages, or create accounts by automated means or under false pretenses;
- (c) circumvent, disable or interfere with security features of the Services, or try to bypass measures that restrict access to them;
- (d) trick, defraud or mislead us or other users, including attempts to obtain account credentials or other sensitive account information;
- (e) upload or transmit viruses, Trojan horses or other malicious material, or anything that acts as a passive or active information-collection or transmission mechanism;
- (f) interfere with, disrupt or place an undue burden on the Services or connected networks, or frame or link to the Services without authorization;
- (g) impersonate another user or person, use another user's username, or misrepresent your identity or affiliation;
- (h) use information obtained from the Services to harass, abuse or harm anyone, or harass, threaten or intimidate our employees or agents;
- (i) decompile, disassemble, reverse engineer or try to derive the source code or algorithms of any software in the Services, except as the law expressly permits;
- (j) copy or adapt the Services' software or code, or remove copyright or proprietary notices from any Content;
- (k) make the Services available to third parties, resell them, or use them to build a competing product, except as your agreement with us expressly allows;
- (l) intercept data not intended for you, or damage, reveal or alter another user's data;
- (m) misuse our support services or submit false reports of abuse or misconduct;
- (n) sell or transfer your profile or account (see also the Terms and Conditions, Section 11); or
- (o) use the Services in any way that breaks applicable law or regulation.
4. Prohibited Business Categories and Restricted Regulated Uses
4.1 The Services may not be used in any way, or in connection with any business, that:
- (a) promotes violence, self-harm, terrorism or criminal activity;
- (b) facilitates harassment, hate speech or discrimination;
- (c) distributes sexually explicit content or operates adult services or escorting;
- (d) involves gambling or get-rich-quick schemes, or promotes multi-level marketing (MLM), pyramid or Ponzi schemes;
- (e) breaks privacy laws or involves selling personal data;
- (f) uses misleading, deceptive or spam-based marketing;
- (g) sells or promotes illegal or high-risk items or services, including controlled substances and drug paraphernalia, cigarettes and tobacco, regulated knives or weapons, firearms, ammunition or regulated firearm parts, stolen goods, goods the seller does not yet control or possess, or products or services government agencies have identified as likely to be fraudulent;
- (h) handles regulated products or services (for example firearms, pharmaceuticals, alcohol or financial services) without the required licenses and compliance; or
- (i) supports deepfake generation, political misinformation or harmful AI automation.
4.2 Regulated-industry restriction. The Services are not designed to meet industry-specific regulatory frameworks such as the Health Insurance Portability and Accountability Act (HIPAA) or the Federal Information Security Management Act (FISMA). If your use would be subject to such a framework, you may not use the Services for that purpose. You may not use the Services in a way that would violate the Gramm-Leach-Bliley Act (GLBA).
4.3 We may suspend or terminate the Services immediately if, in our reasonable judgment, your use breaches this Section 4.
5. Messaging and Telemarketing Rules
5.1 These rules apply to all SMS, MMS and voice communications sent or placed through the Services, whatever the number type or use case, and they implement Application-to-Person (A2P) messaging standards.
5.2 Consent. You may message only contacts who have expressly opted in to receive messages from you. Consent cannot be bought, sold or exchanged; for example, you may not message a purchased phone list.
5.3 Opt-out. Recipients must be able to withdraw consent at any time by replying with a standard opt-out keyword (such as STOP or UNSUBSCRIBE). Your first message to a contact must include opt-out language such as "Reply STOP to unsubscribe", and you must honor every opt-out.
5.4 Sender identification. Every first message must clearly identify you, the party that obtained the opt-in, as the sender, except for follow-up messages within an ongoing conversation.
5.5 Content restrictions. You may not send messages about alcohol, firearms, gambling, tobacco or other age-restricted or adult content through the messaging Services.
5.6 No filtering evasion. You may not design content to evade unwanted-messaging detection, including deliberate misspellings or non-standard opt-out phrases, and you may not "snowshoe" (spread similar messages across many numbers to avoid detection).
5.7 Telemarketing laws. You are responsible for complying with every law that governs your calls and texts, including the Telephone Consumer Protection Act (TCPA), Federal Communications Commission regulations and state telemarketing and texting laws, some of which (for example Texas Senate Bill 140) impose registration, bonding or security-deposit requirements and strict penalties. These are examples, not a complete list.
5.8 Operational sending limits, deliverability protections and do-not-disturb handling are applied at platform level as described in the Terms and Conditions, Section 13, and in our product documentation.
6. Email Rules
6.1 You may send marketing email only to recipients who have consented to receive it or whom you may lawfully email under applicable law, including the CAN-SPAM Act and, where relevant, Canada's Anti-Spam Legislation (CASL), the European e-Privacy rules, UK PECR and Australia's Spam Act.
6.2 Every marketing email must truthfully identify you as the sender, include a working unsubscribe mechanism and honor unsubscribe requests promptly. Deceptive subject lines, forged headers and purchased lists are prohibited.
7. AI-Use Restrictions
7.1 These restrictions apply to all AI Features of the Services. When you use AI Features, you must not:
- (a) use AI techniques that rely on subliminal, manipulative or deceptive methods designed to distort behavior and impair informed decision-making, particularly where this causes significant harm;
- (b) exploit vulnerabilities related to age, disability or socio-economic circumstances in a way that distorts behavior or decision-making, especially where this causes significant harm;
- (c) use AI for biometric categorization that infers sensitive attributes such as race, political opinions, trade union membership, religious or philosophical beliefs, sex life or sexual orientation, except in narrow lawful cases such as labeling lawfully acquired datasets;
- (d) implement AI-based social scoring that evaluates or classifies people based on social behavior or personal traits in a way that causes harm, discrimination or unfair treatment;
- (e) assess a person's risk of committing a criminal offense based solely on profiling or personality traits, outside narrowly defined circumstances with legal safeguards;
- (f) build facial recognition databases by untargeted scraping of facial images from the internet, social media or CCTV footage;
- (g) use AI to infer emotions in sensitive settings such as workplaces or schools, where the analysis could lead to discrimination, unfair treatment or privacy violations;
- (h) carry out real-time remote biometric identification in public places for law enforcement purposes, except where there is strong legal justification and oversight; or
- (i) use AI Features to create or spread unlawful, harmful, deceptive or infringing content, or in a way that breaks the terms of the underlying AI service providers.
7.2 You remain responsible for reviewing AI outputs before using them, as described in the Terms and Conditions, Section 15.
8. Content Standards for Contributions
8.1 For every Contribution you post, upload or transmit through the Services, you confirm that you own it or have the rights, consents and permissions needed to use it and let us use it; that it complies with applicable law; and that you have the verifiable consent of every identifiable person shown in it.
8.2 You may not post, transmit or upload any Contribution that:
- (a) breaks the law, a court order, a contractual obligation, this Policy or the Terms and Conditions, or promotes or facilitates fraud or illegal activity;
- (b) is defamatory, obscene, hateful, harassing, bullying, abusive or threatening, or discriminates based on race, sex, religion, nationality, disability, sexual orientation or age;
- (c) is false, inaccurate or misleading, or misrepresents your identity or who the Contribution is from;
- (d) includes child sexual abuse material, asks anyone under 18 for personal information, or exploits anyone under 18 in a sexual or violent way;
- (e) promotes violence, advocates the violent overthrow of any government, or incites, encourages or threatens physical harm;
- (f) promotes, facilitates or assists terrorism;
- (g) infringes anyone's intellectual property, publicity or privacy rights; or
- (h) contains unsolicited or unauthorized advertising, pyramid schemes, chain letters, spam or mass solicitations.
9. Reviews and Ratings
9.1 When your Contribution is a review or rating, you also agree that: you have firsthand experience of what you are reviewing; your review reflects that experience truthfully; you are not affiliated with a competitor if posting a negative review, nor connected to the product if posting a positive one; you will not draw conclusions about the legality of conduct; you will not post false or misleading statements; and you will not organize campaigns encouraging others to post reviews, positive or negative.
9.2 We may accept, reject or remove reviews at our discretion. Reviews are not endorsed by us and do not represent our views.
10. Your Compliance Responsibilities
10.1 You are responsible for your own legal compliance. The Services are tools. We do not give legal advice and do not guarantee that your use of the Services complies with any law. You alone are responsible for making sure your use of the Services, including every message, call, email, campaign, automation and AI output, complies with all laws that apply to your business, including:
- (a) federal communications and marketing laws such as the TCPA, FCC regulations, the CAN-SPAM Act and Federal Trade Commission rules;
- (b) state telemarketing, texting and consumer-protection laws in every jurisdiction where you do business;
- (c) consumer privacy laws such as the General Data Protection Regulation (GDPR), UK GDPR, the California Consumer Privacy Act (CCPA/CPRA) and similar legislation; as the account holder, you are the data controller for your contacts' data and are responsible for obtaining consents, honoring opt-outs and fulfilling data-subject rights;
- (d) industry-specific obligations such as HIPAA for healthcare or FINRA rules for financial services, subject to the restriction in Section 4.2; and
- (e) international marketing and privacy laws such as CASL, UK PECR, Australia's Spam Act and the European e-Privacy rules.
10.2 Laws change. Marketing and privacy laws change often, and it is your responsibility to keep up with current requirements where you operate. Laws named in this Policy are examples current as of its effective date; we do not warrant that any reference remains current, and you should take your own legal advice about the requirements that apply to your business.
10.3 No guarantee of delivery or compliance. Carriers may block messages, regulators may change requirements, and your use cases may be subject to sector-specific rules. Our disclaimers about delivery and compliance are in the Terms and Conditions, Section 22, and your indemnification obligations in Section 24 of the Terms apply to breaches of this Policy.
11. Reporting Violations
11.1 To report a Service, Content or Contribution you believe breaches this Policy, email [email protected] with details of what you found and why you think it breaches this Policy.
11.2 To report suspected intellectual-property infringement, use the process in the Terms and Conditions, Section 18.
11.3 To give feedback about an interaction with our AI Features, email [email protected] with the context, your concern and any relevant screenshots. We will reasonably decide whether a breach of this Policy has occurred.
12. Enforcement and Consequences
12.1 Consequences for breaching this Policy depend on how serious the breach is and your history on the Services. Depending on the breach, we may:
- (a) issue a warning and require you to stop the practice;
- (b) remove or restrict the Content or Contribution, or require moderator approval for your future posts;
- (c) temporarily suspend your access to specific features (including AI Features) or to the Services while we investigate;
- (d) permanently terminate your access to the Services, particularly for serious breaches or breaches that harm users or breach privacy or other regulations;
- (e) notify law enforcement or regulators, or take legal action, where we believe there is a genuine risk to a person or to public safety; and
- (f) for incidents that affect public trust or involve serious ethical breaches of our AI standards, publicly disclose the breach and our response.
12.2 We have no obligation to monitor the Services or Contributions, and the disclaimers and limitations of liability in the Terms and Conditions, Sections 22 and 23, apply to enforcement under this Policy and to other users' breaches of it.
12.3 Where we find a messaging-policy breach, we will where possible work with you in good faith to restore compliance; for serious breaches we may suspend access with limited notice to protect messaging for all customers.
13. Complaints About Removed Content
13.1 If you believe your Content or Contribution was removed or blocked by mistake, contact [email protected]. We will review the decision promptly; the material may stay down while we do.
14. Prior Versions
